I ordered 6 bottles of Kaiken Ultra Malbec 2008 as gifts for Christmas 2012. I had particularly ordered from Evingtons Wines as they were the only shop I could find with stock of 2008. I was surprised when 6 bottles of the 2009 arrived.

I phoned the shop and spoke to Simon who was apologetic in word but did not seem to think that there was any major issue in having sent me the wrong order. I explained that if I had known that they were selling the 2009 I would have bought it elsewhere. I would have made a £9.60 saving. Considering the inconvenience of having to inform them of the mistake and the fact that I had to delay giving the gift until the issue was resolved I suggested a £20 refund was fair and reasonable. Simon was most rude at this suggestion and called me "penny pinching". He also refused to refund even £15. I therefore suggested that as the item was not what I ordered that I would like to return it and receive a full refund. He said I would have to pay for the postage. It was only by making him aware of his responsibilities as a distance seller, and the fact that I was yet to receive the order I had paid for, that he finally agreed that a small cash settlement was a way forward.

I have had one or two mistakes like this with online purchases with other companies and they have always been willing to either collect the goods or cash settle. They have always been polite and very apologetic. Sadly this is not the case with Evingtons Wines.
