“LACK OF RESPONSE THROUGH EMAILS AND IMPOSSIBLE BY PHONE ”

I am averagely happy with the handling of my debt management but what I am most unhappy about is you never ever reply to ones emails. As for phone calls that is just impossible, the chances of ones call being answered is slim. The few times I have been able to speak to someone my problem is handled in a very professional manner which I am happy about.

When the Financial Conduct Authority came into action in April 2014, they conducted a thorough investigation of Lawrence Charlton and all of their 14 associated Debt Management Brands. They found that LC were withholding just over £750,000 of their clients' money and have been holding it for many years. This is due to the fact that when they issues cheques and BACS payments to creditors, if any details are incorrect the payments are sent back. The issues with this is that LC have no process for what to do with that money when it is returned and so have been holding this money for years as it continues to grow. They are currently in the process of trying to return this money to their clients. Some people are being refunded pence, others thousands.

The issue with this is that they are not telling their clients that in accordance to UK Financial Laws, their clients are entitled to claim interest on this money for the length of time it has been held for at the current rate of interest set by the Bank of England.

I urge anyone who has any affiliation with Lawrence Charlton, Debt Free Direct, the Fairpoint Group and any of their affiliated brands to get in touch with them and request your money back plus the interest you are legally owed.

I worked with these guys in a middle management position for 3 years and I've seen the underhanded and deceitful lengths they will go to in order to cover up the truth. Please get in touch with them as you have nothing to lose and a lot to gain.

“still waiting”

IVA completed May 2014 now November still waiting for certificate and monies, been given every excuse under the sun for delay including, your case is priority, it will be ready in 10 days, there was an error in paper-work, now told it will be within 6 weeks,ect ect.incompentence or lies.

they keep doing same to us ours was completed in march.we even had e-mail confirming this .but no citifficate.even stating some info was missing but would have no bareing on out come.now they claim they have had no info in last 5 years.and want last years resending which we dont have as we sent to them .1 of there staff owend up to lots of peoples data being lost.they denied after this happend after .i beleve there after more money as they work on commision.i have in last few daysheard of some one i knew in bristol whos wife commited suicide because of these low lifes.i am going to get this confirmed before i get the guy who lost his wife to go public.they wont care because they a probaly chase him to get some of his dead wifes life insurance.but good luck with your quest

“Deed of assignment time scale”

Hi everyone, I have completed my IVA with this company and I havn't had my certificate in over 2 years because of the pursuit of the PPI on the creditors behalf. Just before Xmas they sent me a deed of assignment in order that they may close my case which I sent back to them but when I contacted them to confirm that they had it,they send yes they did and then I received an email from a member of staff stating that they had not.After sending out up to 4 deeds of assignments so far I am ringing in only for them to say that they are not being received.I don t know what this is all about but please comment if you can help. Many thanks.

Please remember that PPI is your own money falsely obtained from you in the first place. Why on Gods earth would you assign it back to them. Jesus had the right idea when he chucked them out of the Temple! If people don't organise an stand up to this injustice then there is little hope or example to set for future generations!

“BE AWARE house owners, before taking out an...”

Even though DFD are helpful and give good advice helping you decide whether an IVA is for you, depending individual circumstances!! BE AWARE they do not tell you before! accepting the IVA, that in the 4th year of your agreement, you could be forced to remortgage your home or even forced to sell it!! if you have more than 5% equity in your home......to pay off the remaining 50% of your outstanding debt.I personally was not informed of this!! WHY wasn't I!! This is very important and should be highlighted before you consider an IVA. I only found out by new terms & conditions that came in the post recently!! so when I inquired about these new terms! I was told that this is the review 4th year reference old terms but only with your existing lender! So i asked what are the new terms then?? the reply was new side emerging companies (mortgage brokers) that can help with remortgaging your home on the 4th year without your exsisting lender being involved.I personally do not need another remortgage!! that's why I turned to an IVA program to avoid more debt.I was lead to believe that the IVA was an agreed sum arrange by the IVA and lenders/debtor!! but this is not quite the case!! as I am now thinking in my 4th year they could technically turn my life upside down after 4 years of almost seeing light!!! MY advice do not trust anyone and check all terms out before agreeing as no body really gives a damn!! If I knew what I know now then bankruptcy etc might have been an option, a lot less painful. Remember the IVA companies are in this for profit!! Make up your own mind to WHY they don't tell you at the beginning of opening your IVA!! I'm lead to believe,You may possibly have to pay the whole outstanding remaining debt back that you owed in the first place less interest of cause................... IF you cannot pay the remaining 50% off at the end of the 4th year hence no equity in your property!! you could be forced to pay for another year into your IVA program making this 6 years instead of the 5 years you were hoping for......not taking into account an extra year of non payment after the IVA finishes! as it will not be off your credit file until then!! so could take all of 7 years before DEBT FREE with all this disappointment put to you after 4 years of hardship and then......... thrown to the lions!!! think before you sign. I hope this helps. The biggest GREY area of IVA's.......................................... DFD, I will be seeking legal advise reference the new terms & conditions, will post soon for an update. we are going through the same thing.have extended it 12 mths taking us to 6 years was told today that we have to extend a further 12 months, after being told 6 weeks ago that our last payment would be this october. We are so distraught We have now decided to seek legal advice. and have asked for a complete breakdown of every single payment to each creditor to see if we can possibly contact them ourselves to finish paying them off. wish us luck next stop is the ombusman and watchdog.

“They only answer what they want to”

I have been with DFD for 2 years in an IVA. Thay are ok but a real pain to get hold of by phone. Especially on premium rate numbers which are extra on my phone bill.!! When I had my initial chat i was told i could pay £170 a month but after everything was sorted this soon rose to well over double that. How convenient!!! You are left to live on peanuts in an IVA. (id love to meet the person who thinks you can live on £30 a month after your bills) They probably have a massive house with a butler and nannie!!. DFD are very choosy on what they answer and anything that might be deemed to be a bit of a touchy subject, they ignore completely and hope it goes away. Especially if you think your being done over or you have evidence of something!! When they e mail you they wont put their name at the bottom. WHY!!! I have asked many a time on how my payment was calculated but am still waiting 2 years on. I cant wait for this to be over. It feels (Not that ive been their!!!) like I can imagine for someone whos on police bail. Your every move feels like its being watched. These creditors are at fault also for giving stupid credit limits and helping to get people in this mess.

“DFD - Research Before Contacting!”

Like a lot of people my money problems had spiraled out of control, a colleague highly recommended DFD to me and I gave them a call after our conversation. DFD were very keen to take on my case and sent out a chap to collect my paperwork from me the next day. Initially I felt they were very persuasive and almost pushy. They were the first company I had contacted and as I felt I had nowhere else to turn and agreed to the IVA. It took about eight weeks from the start of the process for the IVA to be approved. However during that time I was given conflicting messages from different people at DFD about paying my bills. I am now four months into the IVA and I had hoped that the pressure from my creditors would have stopped, but I am still receiving phone calls and letters from debt collection agencies demanding full payment as they havent received the IVA paperwork from DFD. I have made numerous phone calls, sent emails, faxes and letters chasing DFD up and have had to send my creditors the paperwork myself as DFD do not seem keen on doing so. Another thing I would be wary of is the bank account that DFD recommend you use; there are other free high street bank accounts that people with bad credit can use. I found out the hard way that Secure Trust Bank, who DFD recommend have silly charges and make paying money into your account difficult. They are keen on getting you to save money but recommend a bank that has a set up fee, charge £12.50 a month to use the account and 50p each time you withdraw money. I am now in the process of changing this bank account. I would advise that you do your research before even contacting DFD as they can be very pushy. I have since learned that the Citizens Advice Bureau offer free advice and can help set up IVA's free.

“Good overall but missing some of the little things”

Generally I've been happy with the service until a recent omission by a CS rep caused a payment change not to happen properly causing me undue stress. A simple reminder would've solved tha issue beforehand but it would seem they were just too busy. Nevertheless my complaint was handled well by the management team and I now consider this matter closed although it has dented their otherwise spotless record up to this point. As with a lot of CS these days being offshore I'm grateful that they still have their call centre manned in this country which is a big plus, they just need to brush up on the little niceties which turn average CS into excellent CS. Keep working on the little things guys and you'll soon be 5 star.

“IVA”

I am using Debt Free Direct. The staff are always friendly but sometimes I find that when im seeking help (which i often do as im not an IVA specialist) I receive contradictary responses and then because different people are telling me to do different things i end up worried that im doing things wrong and that ill end up being clattered further down the line. Also i have had to send things by post which I always do either special or recorded delivery and check that they have been signed for only to find out that im told these letters havent been received. A bit alarming when you are told that they have been signed for by someone in the office. Where do these letters go? This also worries me. I never get a reponse to any of the letters ive sent either so I just assume they have been dealt with and have kept the proof that I sent them.

“Generally happy bar two points.”

I was happy with the IVA process as a whole (long and arduous though it was!) and am obviously now thrilled to be debt free for the first time in years. But there are two problems I had with it: I own NOTHING - have no car, house, own very little personal property.. yet at no time was I told that in these circumstances bankruptcy might have been a better option than a five year IVA. I feel I could have been better advised at the start. Oncethe five years were up, I feel I could have been sent something to mark it... a little advice booklet or SOMETHING (kind of a 'So now you're solvent,what can you do?'). Advice regarding future loans, credit rating, etc. would have been most welcome at this stage. Apart from that, it's been great - staff were always freindly and helpful when I called and overall I'm very gald I took the plunge. Thanks.

“have DFD been any good? how about NOOOOO!!”

i got carried away and had no idea of where all my money was going when i was young, i didnt know much about about APR's and my life got in a mess. before i knew it i was in +£40k of debt. i was advised to go with the CCCS, they were great helping me sort things out but id be paying them off for the rest of my life so i knew i had to do something else to get it sorted. i looked at bankrupcy but it would put my job in jeopardy and it would have a longer lasting effect so i went for an IVA. the CCCS recommended DFD, so i thought id give them a go. i had questions i wanted to ask DFD before i took out the IVA, they seem to answer me ok, but things seemed different further down the line. i asked what would happen if we started a family? DFD said that they would reduce my payments to take into consideration paying for a family. when it came to reviewing me DFD said they wanted to charge me £500 to do another sit down with all my creditors to see if they could reduce my payments. i couldnt afford £500, so i had to stick with it!! every year my out goings and cost of living went up and up, my salary stayed the same but DFD wouldnt reduce my payments even tho i said i needed to reduce my payments. at approx yr3 i said i really needed to reduce my payments they said they could reduce my payments but they would extend past the 5yr mark! i now have 5 payments left and ill be glad when its done so i can get on with my life. i wont have to worry about how much more money DFD are gonna try to screw out of me at my yearly review! DFD have served a purpose by providing me with an IVA and ill be debt free after a long 5 yrs, but its not been as clear as they made out! once u enter it, its not easy to reduce your payments even after u have 2 more additions to your family. plus the 5 grand in fees that you u pay to DFD! its really worth looking around at other agencies to see if they can provide an IVA but have better customer feedback??

“Would I do an IVA again? No.”

When I applied for an IVA, I had just split from my partner of 11 years, had moved out and bought my first place on my own, was a teacher in a stressful school and was £26k in debt. I thought my world was going to end any minute. I couldn't function. The initial set up process was speedy - once approved, in a matter of days, DFD were very efficient with calls and paperwork. 6 weeks later, it was all in place. But during the process was another matter. Queries I had were told to be put in writing. They took at least 6 weeks or more to reply. Calls were vague as notes on my file didn't seem to have been in place. Felt very stressed waiting for answers. My biggest problem was when a bank error took my account into slight arrears one month - but it wasn't picked up for nearly a year. Cue a phone call from DFD wanting a by now substantial payment to cover it. I was cross it wasn't picked up, and my letter asking for an explanation was never replied to. Annual reviews seem to be vague. I ONLY ONCE GOT A STATEMENT SHOWING WHAT I HAD PAID IN, despite them writing in response to my complaint letter about this telling me they had sent me accounts annually - they so didn't. Even now, on completion, I have no idea at all what was paid in by me and what went to creditors. Crazy! In the end, I learned that they wouldn't bother sending me that information at each review! I just got on with it. Having just completed 5 years, I still have had no completion paperwork. I presume I have to phone THEM! So odd paying all that money in and having no statement or accounts to show for it. With hindsight, I should have seen that life does change. I changed jobs, I should have entered into a `freezing of interest` arrangement direct with creditors and paid my debts off direct rather than lazily taking an IVA that messes up your credit rating and means you pay more in the long run. As teacher, I had to freeze my pension and I am so cross about that now. It has cost me thousands in retirement `benefits`. Would I recommend an IVA? No, not if you have support from your family, a way of possibly changing jobs, getting promotion in the future or taking on a second job. All of that must be a much better way of paying off debts than being stuck in an IVA. Think very carefully before you commit - if there is another way for you, do it. Life can change and so can your financial circumstances. I am in a different place to 5 years ago. And don't sign with DFD if you are used to lots of efficient accounting and letters - you will not get it. The advisors were lovely on the phone, that wasn't the problem. It was the lack of monitoring of my account/lack of a personal service/letters once you are in the IVA.

I have completed and STILL no one from DFD has contacted me to confirm completion. Customer service for people about to sign up is great....but when you have already signed, it is lacking. Definately think of other ways to pay back your debts!

“IVA last resort”

I went to DFD when i was in need of help running into a 15k debt. i was younger and desperate and saw this as the only way out. The advisors were very helpful and went through all my expenses and worked with me to enter an IVA to stop creditors getting in touch with me. To be honest i was younger/naive/desperate back then and had so much paperwork i didn’t fully read it all, the main things were outlined to me; that i would be in an agreement for 5 years, creditors would stop contacting me, interest would stop, i COULD remortgage after 4 years to end it early and i pay no fees as the creditors pay them. Fantastic sounds great! all through the first 3 years everything went well, i pay my monthly amount and i could forget about things and the DFD advisors were so helpful. In my forth year i went through a divorce, i couldn't remortgage and advised Debt free of this who have just said send in your mortgage redemption cert and that was that, now at the end of my 5 years i feel that DFD are against me rather than helping me. I was in 15600k debt to begin with, all my payments over the 5 years equate to 15k so ive pratically paid my debt off, yet now it comes to light that because i couldn't remortgage at the time i now have to go on another year with it so will be paying back another 3500 on top of the 15k i have already paid back so creditors can get more of their money back, well that kind of contradicts the fact that 'i dont pay the fees the creditors do' then if they can then claim more back to cover the fees. Looking through my agreement yes it does state that i will need to go on another year should i not remortgage... hidden nicely under the court stamp and also has no monetry value attached to that, so even though you've paid your debt you have to pay even more at no capped rate. Looking back i don’t think i would have entered the IVA knowing what i know now. back then i thought i was being responsible in taking my debts into hand and getting myself out of it without family help. Now i realise i should have just asked family and swollowed my pride then i wouldn't be in this frustrating state i am in now, instead of being able to celebrate being debt free im now stuck in for another year. Read your small print carefully, take it to citizens advise if you can to look at it with you. Think very carefully before entering any arrangement, it may sound good saying they can write so much of your debt off but have they really?? yes the creditors haven't had the full amount back because they have to pay DFD's fees out of your monthly payments but i've still paid the full amount back regardless of who received the money.

“Have trouble contacting anyone”

I would say that in the beginning DFD were very helpful in the set up of the IVA, but since it has been put in place, I have had a lot of contact from one of the creditors and when I have tried to get in touch with DFD there doesn't seem to be alot of help to deal with it. I would prefer to speak with someone on the phone when I have a problem not do it through e-mails

The service did what it said on the tin, it took a lot of pressure off, and kept the creditors off our backs. A bit disappointed that having completed the IVA in Feb 2011, my credit rating is still very poor.

“Fair, Upsetting, Regret”

My intital phone call ok and friendly and then found working with DFD frustrating, stressful and not very clear(intially). A company who provide a necessary service to the needy financially, but have no after care once signature of the legal documents have been completed. Conversations with various people have left me just one of the many, no human compassion in the conversation (not everyone but I can count on 1 hand). As a customer I understand being busy, I understand people have an off day, but I found that I felt like a burden. I am now dealing with one person and that is the way I want to keep it, not quite sure if I would recommend the company but now I am tied to DFD to help my financial problems which now we have seemed to settle a little. Still waiting for information still after a few weeks since initial contact.

I was surprised that even though my income had decreased and my expenditure increased, a reduction in my payments was not suggested until I mentioned it. I thought the whole idea of the review was to check affordability and agree payments that can be afforded. Apart from that the review was conducted in time.
