rogue data charges

I've got an MDA III on contract. After my first bill I discovered I had over £100 in data charges (even though I never used WAP or internet). Queried it with T Mobile and they said I had used it. So I deactivated WAP and internet access totally off my phone, but still getting charged with data calls. Last count it's almost £300. Yet I don't even use the phone anymore, so how can I get charged for something that there is no physical way of accessing. T mobile keep saying they will investigate, but they don't. Can anyone tell me what is happening or how to get out of this nightmare contract?

i would cancel the contract with tmobile and then unlock the phone and get a new sim card
