Purchased Chaise Longue and Armchair from Scala leather range in store at about GBP 2000,-. After less than three years of occasional use the Chaise Longue already showed significant sagging at the seating end, suggesting poor foam padding. As Habitat has gone into administration in June 2011, they are not required to care about potential prior warranties, but as the range was still being sold in store, I would expect someone to show some interest in customer experience with their product.... In fact, the order is only still active because of my constant phone calls to Habitat. I'm in the same boat too! Placed an order on 5 December, 3-5 day delivery. By 15th it still hadn't arrived so I spent 8 minutes on hold before speaking to someone. She informed me that as they were 'transitioning' the order would no longer appear on my account online and it would be on her spreadsheet. She checked and confirmed all items were still in stock and would arrange for them to be delivered. Great - although I said refund me for the tablecloth as I had had to buy an alternative elsewhere as I'd needed it for the 11th! She said she'd arrange a cheque refund - I said don't, it will probably get lost in the Xmas post and you won't believe me if it doesn't arrive, refund it to the card I paid on. Apparently this is no longer possible as they have changed systems. Ridiculous!!!!
She then rang back and left a message saying all items BUT the tablecloth were out of stock and to ring her back. I rang back....16 minutes on hold by which time I was so frustrated I gave up. I sent a second email titled to her name hoping she'd be shown it, stated everything that had happened and cost on phone calls. No response, then I get an email saying "ticket closed" so I sent the email again. I sent 5 emails in total after I was ignored each time. I then called again yesterday, spoke to someone who seemed helpful, would speak to manager and ring back. They didn't. Just spoken to someone else again who has to check with the 'admin' team and will call back on Tues when they're back in work. I won't hold my breath or I won't see much of 2012!!!!

I'm sorry to hear others are having the same problems. I've sent a complaint email 5 times now and had no response. I've given up on ringing them as I had £7.00 worth of charges for the calls I made to them in December which got me nowhere. I've now reported them to Consumer Direct, Watchdog and Martins Money Saving website. Consumer Direct have advised me to write a letter to head office (sent recorded so I can prove they received it). They also told me this....
'To make a claim it would need to be proven that a breach of contract has occurred. A breach of contract will occur when one party to a contract fail to meet their part on an agreement.
In your situation, you will argue that Habitat are in breach of contract as they have failed to deliver the goods as agreed.'
So they are definitely in the wrong. I suggest you write to them too and make sure you mention your 'legal rights' and also keep a copy of the letter as 'evidence'. If Habitat refuse to respond then it is possible to take them to the small claims court, although I doubt I'll take it this far as I've only lost £9.00, but others who have lost more may wish to consider this.
I do feel a bit silly getting so angry over £9.00 but its just blatant thieving! And the lying by the customer services team and the refusing to respond when you complain. It really is so frustrating.
