“Unfair contract”

We recently signed up to a contract with Peninsula and found after just a few days, and having reviewed the contract details, we wished to cancel, but to our surprise were told that it was a 'business contract' and NO cooling off period was applicable. We read the reviews and would suggest that everyone does BEFORE signing up, you would then not sign. If there is insurance involved, by law, you have a 14 day cooling off period: I hope this advice doesn't come too late for you and your company. Otherwise, you may be locked in to the contract. Word of advice: check the caveats on cancelling to ensure you meet the deadlines for cancellation and you are not locked in for a further period. Best of luck - Legal Earth.

“The complete opposite to what you intended to happen”

If you want to sign up you can guarantee the salesman will be with you the next day. He will promise you the earth, he'll will tell you how wonderfull they are. When it comes to them delivering the goods, be sure they won't. When you try and contact them they won't answer the phone or return your emails, they won't come and see you. Then the penny will drop you have been well and truly tricked out of your money! and that's all they are interested in. I don't know how they can get away with... (read more)

“Ill Advice Cost me Money”

As a small business owner, I signed up to Peninsula's HR service for 12 months and found that I needed to use them to address an employees purposely difficult behavior which then resulted in a claim for unfair dismissal. And moreover when it came to the end of contract they DID NOT inform us at all .We assumed our contracted had finished. Only to be told that it has gone on a ROLL OVER contract. Unbelievable! And when we wrote to them-they did not reply for 6 months! Again asking for payments for those 6 months periods! It is most unethical if not illegal way of extracting money from customers! As a new small business I signed up with them as I was naive and have been paying them £135 per month since 2007. Peninsula Business Services tie you into a 5 year contract which there is no getting out of and dont make it clear that you have to give 12 months notice in which to get out of it, so effectively you are signing up for 6 years. I had a meeting last year with what seemed like a very nice sales person, selling employment services for Peninsula. During the meeting I asked about cancellation she informed me that I would have to be with them for at least six months to cover any work that had been done on my behalf. I have just tried to cancel and have now been informed that I signed up for 5 years!!!!! Unprofessional, incompetent, they can't even communicate between themselves in the same office space let alone departments, they seem to be hell bent on protecting their indemnity more than they do their clients and give advice that protects them leaving you with a bigger headache than if you had dealt with the situation yourself. You have looked into our concerns but to an unsatisfactory level, it's not just the insurance it's the pure level of incompetence, conflicting advice, poor advice, and lack of communication between your staff and your departments. Did I say lack, I mean devoid of communication. Nice little advert you snuck in there. If you have so few complaints as your post suggests, you will not require the services of a detective to figure out who I am.

Hello my daughter used to work for Peninsula along time ago and I have not read the 70 reviews. I count 51 some from the same company and its clear that a lot of you have signed up to contracts you now want to get out off. From personal experience you cant be sued if no service has been delivered. It appears there are few unhappy people who want to get out of contracts. What a shame Peninsula cant help but my daugher did a good job and none of her clients were ever unhappy.

We have not 'just signed up and now want out'...it's the fact that we were MISSOLD it in the first place. How would you feel if you signed up for something and were led to believe you could cancel at any point....then to find out that you were tied into a 5 year contract? Your daughter may have been good at her job and was honest with her clients but that really doesn't help us that have been duped, does it! I agree that it's a shame that Peninsula can't help too.

It's not what you do that we have a problem with it's the fact that your sales people are being dishonest when selling to companies! 5 years is a silly amount of time for anyone to sign up, especially in the current climate........that's obviously why they are omitting this vital piece of information when making the sale!

Hi, I'm in the same boat as you. Lovely sales lady comes to the premises telling you all you want to hear...then you go to cancel it and you're informed that you signed a 5 year contract! She most definitely did not mention that to me and when I asked about cancelling she told me I had to be with them for at least six months to cover work they may have done, which I thought was fair enough. I have a small business with not many staff which is now struggling and would never have signed up for that length of time! I wish I'd read the reviews before I signed. A lesson learnt! Something should be done about this!

There is a way out - one of peninsula's competitors has taken this up on behalf of a lot of unhappy customers, and are challenging the potential miss-selling & the contracts involved, obviously they are hoping to pick up some of these clients themselves, and they probably will as they have no contract whatsoever!

Bondibabe, if you have time read further and you'll read about some of the nasty games this company is involved with. Every solicitor I have spoken to recently has nothing but bad things to say about this firm, one even called them evil! May I ask when you signed your "1 year contract" please? I'm glad you were offered a 1 year deal, we wern't, we were informed it was 5 years originally and then they reduced it to 3 years, of course, this was the sales man talking. It's interesting that you recieved a one year deal as it shows the policy was mis sold to anybody that signed up for longer.

“Peninsula - Con Artists stay well clear”

We signed up after going to a presentation, every time we contacted them about a staff issue we were told to sack them. We ended up with no staff only self employed people, when we tried to cancel we were told we had to pay for next 5 years. When we said we were not happy with the service received; always being given conflicking information as you never get to speak to the same person twice. i would. You can warn others about their shameful service. They also say their training is free. I enquired about this 3 months ago and ive been ignored, and promised call backs and information. I had 1 call telling me about a few training sessions which cost over £400 each. Breach of contract. Their website doesnt allow you to sign in to the trainning schedule either. Again breach of contract. If i were you id get legal help in relation to breach of contract.

Your Lucky. We had a staff member, who didnt tell the truth, bullied, was ill every week, when we signed up they told us it was a 3 year contract, but signed us up for 5 years. They dont reply to emails as quickly as they say ie within 24 hours and at times took them 3-4 days as the person we last spoke to wasnt in. It took us 6 months to get rid of him and that was when we told them, we couldnt do any more to avoid a claim against us and that we held so much evidence against this employee, that we were going to just get rid of him with or without their help. This employee cost us a lot of money, caused problems with other staff members, one even went on the sick because of him bullying, and whilst we were paying him to not work, i was spending all day every day compiling evidence, holding meetings with staff making complaints, interviewing everyone in relation to complaints of bullying etc. EVERY staff member we have, had information and evidence against this employee, yet still, no you cant get rid of him yet in case he sues us because he had mentioned age discrimination. He was in his early 20's, yet there was someone younger and someone above retirement age and there are other members of staff that were 2 years older, so age discrimination would not have stood up anyway.

I have heard of people cancelling the contract and claiming breach of contract. If you have got evidence they have tricked you into signing, or evidence they have not held their end of the bargain, i believe you have grounds to appeal the CCJ and actually sue them for the trouble they have caused you.

How do you get a CCJ if they have breached the contract? I have just applied for a job there? And they showed me a room with comments on the wall from thousands of businesses? Are they not real? These reviews dont appear to be stopping them. The building and staff were very impressive. They showed me a floor with 200 HR people on it.

I am not gagged with peninsula ,but if you feel you have been mis-sold follow my past instructions, go straight to your mp surgery tell him your story with any evidance and tell him to contact Mp, cant go into any detail and out with Mp there other things going on which you will hear about in the future.no need for appointment for Mp just go straight to his surgery when it on and if you do contact your mo office and they say it sounds like a legal matter tell them it isnt because there no law to protect and as soon as your mp talks to mp he should help you , plus get them to send a letter to peninsula too, All i can tell you is out with mp there other people on peninsula radar, regards john

Not sure if the English contract is the same but I was required to give six months notice on renewal. I dont see how your situation relates to peninsula business services. You cant review a company based on your own business. Peninsula do not stick to their contract, if we buy and dont use, that doesnt mean that someone else cant use 'a room'. Peninsula trick you into buying things they either offer for free, tell you your contract is for 3 years then give you 5. Thats like you telling your guests that you have booked them 3 nights, but actually booked and taken the money for 5 nights. Clearly something they would not be happy about. At the end of the day, if you havent used someones services, then you cant really offer a review and your 4 stars conflicts and falsifies the rating which gives false information. If i was happy, id leave a happy comment supporting them but im not.

Most people come here when Peninsula don't deliver, then find it's like owing the mafia - no service? PAY, don't like the wait? PAY. Still waiting for them to deliver what was agreed? PAY. Then, when you get fed up and stop paying for breach of contract - you then find they go for you for.. NOT PAYING (breach of contract!) - that's when you take advice and discover that the only thing clearly determined by the arrangement it that you have to.. PAY!

Peninsula Business Service are regulated by the Financial Services Authority, FSA, and as such have to adhere to a very strict code of conduct. If they do not adhere to this strict code of conduct they can be heavily fined and even put out of business. Every time you complain to Peninsula according to FSA rules they have to write to you giving you a complaints procedure setting out what you can do. Thanks for the info. The advice we received from solicitors (recommended by FSB) was that regardless of our complaint, (persistent non delivery HR, but OK delivery H&S), which we thought was straightforward breach, their contract tied us up to pay - so our non payment in frustration at their breach, put us in breach. Go figure.

It would appear that advice in parallel to yours would be - "and don't stop the direct debit . standing order payments, document their failings and then implement your guidance with solicitors."

Then "your breach" is not a factor to muddy the water; get the lot back from the courts. Goes against the grain, doesn't "feel" right, and we've all got cash flow to worry about - but don't stop payments at the very least until you have spoken to your company solicitor, it would seem, is crucial.

Peninsula might work for yor company in some way, if you need them, however, you will probably find they are more dangerous than the people they claim to protect you from, I would advise anyone to stay well away from them. I wish I read the reviews before I signed, I have no relevant contracts no correct health and safety, paid for three years and still not had the service I paid for. I have been lied to by staff and now I stopped paying because I have not recieved what I have paid a considerable amount of money for, they say their going to take me to court. Hi Tunerite,

Sorry to hear this. All legal advice I have had says what they they are doing is "within the law" though it is in no way morally correct. Basically the contract is designed very well to 'prey' on the smaller business when you'd expect a little 'help' in these turbulent times.

I am taking our case up with my MP and I suggest you do the same (See Freck1975 posted Jan 2013) he suggested this and has had success and with a few more people doing the same it will gain momentum. All MPs have a "surgery" and you can have a 15min informal conversation face to face.

If you want to "carry more weight" in court, try your MP and mention to them that others are doing the same to bring these sinister goings on into the open.

“Keep Well Away From This Company!!”

My husband signed with Peninsula when first starting in business. The saleman advised that he could cancel after 12 months giving 3 months notice. After paying £235.00 per month for a year and receiving no service whatsoever from them, he sent a letter cancelling the agreement. What does your contract say? Ring the Customer Service helpline, ask for the Head of Client Satisfaction and Service. It all depends what you signed on the contract. No different than any other supplier.

The salesman lied to get his/her commission. The company believed this and presumably signed the contract. If the company was misled, and this was witnessed it could be construed as fraud. Also see what service was stated and what was not received. Go back and state your case, do not be bullied. Others READ THE CONTRACT INCLUDING THE SMALL PRINT. Also do not tar all suppliers nor insult them by saying Peninsula is no different, I woul like to think there are many honest suppliers.

Hi Bare1

If anyone has won a case against them, I think it includes a gagging order to secure any compensation/cancellation. Various solicitors I have asked confirm this is highly likely.

When is your court case?

All stories on here seem to have a few common threads and it all centres around the way the contract is sold. As a business you have no claim to being "mis-sold" to like a regular consumer. I believe MPs have the clout to do something about this.

Try contacting your MP here, they run surgeries and will listen to your concerns. Mine seems keen to hear as the small business is after all the lifeblood of the country.

Others are doing this with success - and the more that do the better (See Freck1975 post from Jan 2013)

I needed to save costs, got three quotes for a outsourced HR service and went with Peninsular, very happy on a 3 year deal. I am still trading in difficult times and have HR, Insurance and H&S support. I would get a trial of the services on offer and make your mind up. I am suspicious of this review. Firstly Peninsula is spelt wrong; secondly why is the web address shown; thirdly how does the reviewer know the number of clients Peninsula has; and finally if a limited company no longer trades then all debtors do not fall away, they are dealt with by the Receiver utilising the assets of the company. It may be a good idea to get a new accountant.

????????? I am a client and yes they have asked as part of their Fanatical Fans programme to highlight my satisfaction. I am on a 12 month deal, my monthly payments are stated on my contract. If you sign a one year contract it shows the monthly payments and the total value, I was quoted five years, it showed 60 months and the total deal value. ACAS couldnt offer the insurance, documentation, an employee assistance programme or 23 hour support. I am sorry some people arent happy but I am.

well i hope you remember to notify them a year before that contract ends because if you get your magnifying glass out you will notice that too.thats why we were taken to court by peninsula after we paid promptly for 5 years and never used the services.everybody knows now that in the domestic world the consumer is a bit more protected

Like everyone in business when you sign any contract you should read all the small print, Peninsula clearly say the length of contract before you sign. Always check with your accountant or solicitors we all have experience with these companies.Peninsula have a good service backup and you must also understand that part of the fee is an insurance premium. Being new in business you should not sign anything without getting professional advice. When you do sign a contract most Judges will refer to the contract and if a service has been provided and you signed the contract you are liable, that is a fact of life.

Went to their seminar, had the scare tactics drilled into me. I was very naive at the time, just started a business and it was to safeguard me with my first and only employee. “Business killers, buyers beware!”

After having paid this company for 5 years and hardly ever using their services I notified them that I wanted to cancel at the end of the 5 years. The rep then came to see me to persuade me not to terminate. I explained my concerns about the economy and was assured that if things didn't pick up then they would be sympathetic. “Cost us £6500 !! Avoid these people ”

We also did not realise it was a 5 year contract. Incorrect advice (just plain wrong) concerning taking on an agency worker (all proof in emails) resulted in a CCJ and a bill of £6500 !! Of course because of the advice we did not cancel contract with agency and ended up in court as couldn`t cancel...... Their advice is next to useless as the last thing they want you to do is put them at risk by making anyone redundant. In the end the hoops you are made to jump through make it more onerous... Peninsula, charge way to much for what they offer. We have been badly hit by the economic down turn and have had to close many departments and loose most of our work force. Peninsula, offered very poor advice and where of very little help in this area. Peninsula Business Services, Manchester have all but put me out of business. I was mis-sold a contract which the salesman for the Cumbria area stated could be cancelled by giving 3 months notice. hi, we have had the same problem with peninsula and we have been forced to carry on paying the following years premium of £1500
just because we forgot to give them notice 6 months before the end of contract. even though we never once used their services.
I am also very angry and feel robbedn
we pleaded with them as a company as times are not easy and ended up with a bailiffs court letter.

I have a similar problem with them and am about to fight it in court. I only met with them as I told them my company was likely to cease trading within a year and I wanted to ensure I dealt with employees correctly. They told me that the only paperwork I could sign was a standard contract and they rang their office in front of me and confirmed I would be treated as a business start up and could end my contract without the five years notice. I did just that and received an invoice for 5 years ! They offered nothing I could not have got from ACAS free. I consider them to be con arstists and hope I can get the court to take notice. “Insurance company scam”

This company is just an insurance company scam (not a law firm at all) that has a vested interest in generating as many employment problems as it can. They make loads of money by provoking tribunal claims and are in a win win situation. It matters not to them who wins, they still get paid ££££'s out of the money paid by the mugs who pay their fees. I have had a very similar problem. my company signed up to them on a 1 yr contract thank god, an they did absolutely nothing to warrant what we were paying them. it took them 2 months just to get employee contracts to us where I'd already paid them £2400. the business ceased trading about 2 yrs ago. just this morning a bailiff turns up at my HOUSE to take my car away which they only knew was there when he turned up and noted it down to levi. I isn't let the guy in the house and was demanding 2k just for him to leave us for the day. they claim they wrote to us to take me to court but the first correspondence we had was today when he gave me the court order. If I didn't give him 2k he was going to take my car. so I did what anybody would do and jumped in my car and drove off. they are a rip off company and will seriously try and trap u. I don't think they make their money through their services, I think they prefer to do it by sending u to court and claiming against u for services they haven't even fulfilled. I have had major problems with this company for years. Does anyone know of Peninsula going further than a CCJ against a company? Does anyone know of of a company being closed down by them? As we expected our company ceased trading and has not traded for about 2 years now. However we still trade from or old office premises which a completely different company yesterday we were dumb struck when a Bailiff from the Sheriff’s Office High Court Enforcement Officers turned up at the office to seize goods, Items that belong to a completely different company to the sum of £5291.94. the Bailiff stated that I must prove my office equipment did not belong to my previous company and If I couldn’t he would come back drill the lock of my office and remove all my office equipment.
The Bailiff must have lots of dealings with Peninsula as he told me that in his opinion this was for a debt that is approximately 1-3 years old, were we unwittingly signed into a 5 years contract. This is obviously business for both the Bailiff and Peninsula.
Has anyone else been pressured like this?

Hi. Just filing the defense claim as we speak against Peninsula. We were happy to pay the amount we agreed for 5 years in return for excellent services by proffesional lawyers and Businesswise. Within the first 7 months we found that most of the correspondence had to be created by us ( not what we signed up for as we are not solicitors). We had to call almost on every occasion to remind them that an email has been sent for checking the documents. Stories had to be re-told because no particular lawyer was ever appointed to us (as promised). Businesswise HR package has errors which makes your HR inacurate. Were promised that new website would be ready in the summer 2011. Then it was autumn 2011. Not sure if they ever improved it (not very good when you are a paying customer). We got fed up with the poor service and lost confidence in Peninsula. We decided to stop paying after 7 months and exchange few letters with Peninsula since. They believe they haven't done anything wrong and are now taking us to court for the rest of the money. DO NOT USE THIS COMPANY PLEASE!!!!!!!!

Joined up with Peninsula almost a year ago and am a very happy customer. Thankfully haven't had to test them on an employment tribunal, but they re-wrote all my employee contracts and my employee handbook. Cost is absolutely minimal, was really suprised when I found out how much it was going to be. They rewrote your contracts and handbooks? That's their first step to ensuring that once you have a dispute, it is maximised to the fullest possible extent. Their ploy is to leave important parts practically meaningless so there is potential for lengthy and lucrative work for them. Eventually, you end up footing the bill one way or the other. You ought to get a proper independent lawyer to look at the stuff they have given you. Cost is (at present) minimal? How seriously do you take your employee relations? They say you get what you pay for. When dealing with this outfit you appear to pay little at first, which is, to be fair, commensurate with the real value of what they give you, then later on it costs you a fortune but you have nothing at all.

I had an employment tribunal and I was totally clueless to what I should do. My brother had used Peninsula three years ago to defend against a tribunal. I tried to use his account but you need to sign up to Peninsula separately. However in the end it wasn't that expensive, tons cheaper than a solicitor. It's not the terms I was unhappy with, we wanted it sorted and wanted the confidence of medium term cover. What I was unhappy with was the failure to deliver then the fifteen grand bill for all outstanding months NOW when it was challenged.

There was no ambiguity over the requirement, it was agreed and written but simply not delivered. Different staff, different promises, 9 months (of monthly payments) and no delivery. If this was an isolated story, maybe you could excuse it, but it isn't. Just because some contracts appear, for now at least, to be running smoothly - and good for you - but when you get multiple promises and no delivery, will that still be up to you to extract value?

They are terrible, they will take you to court or land you with bailiffs, they really are the worst company to deal with ever. I have had a bad experience, I know other companies that hav had a real bad expirience too. The cost of what they do is no where near what they charge and they are completely roughless. If your not careful you will have a truck outside with bailiffs that's guaranteed

We are going though the process now they are a terrible company. The sales man told us that we were signing a 12 month contract. but when We tried to cancel with them at the 12 month point over the phone we were told to write them a letter of cancelation. Which we duly did. We explained that company was on hard times and we no longer had any staff and that the company intended to cease trading.
Peninsula wrote back and told us we couldn’t cancel and we were in a five year contract so they wanted all their money paying in one go.
As we expected our company ceased trading and has not traded for about 2 years now. However we still trade from or old office premises which a completely different company yesterday we were dumb struck when a Bailiff from the Sheriff’s Office High Court Enforcement Officers turned up at the office to seize goods, Items that belong to a completely different company to the sum of £5291.94. the Bailiff stated that I must prove my office equipment did not belong to my previous company and If I couldn’t he would come back drill the lock of my office and remove all my office equipment.
The Bailiff must have lots of dealings with Peninsula as he told me that in his opinion this was for a debt that is approximately 1-3 years old, were we unwittingly signed into a 5 years contract. This is obviously business for both the Bailiff and Peninsula.

Has anyone else been pressured like this?

These guys are a bunch of crooks that trick and fraudulently get you to sign contracts with fast because they are always in a rush to get somewhere else.

I cannot believe I am in this position with this company who i thought would protect me against tribunal, health and safety etc and give training to my staff. I now find myself due in court with THEM!! It took me from Dec 09 to April 10 to get draft contracts, we then had a fire and all was destroyed, so we have now been constantly asking, over and over and over again for the draft contracts!!!! We use a company called MBHS for all our Health and Safety requirements, they are nationwide , no contracts to sign, really hands on and experts in individual feels, they also do all of the work for you allowing you to concentrate on your business.

Good luck getting out of your contract you will struggle. I am very close to someone who used to work for Peninsula and they left as they were disgusted at what the company did and how they treat their clients. In terms of their tribunals service the approach they take is to advise that they will provide free tribunal support and this is what the company advise the sales force to tell customers. Peninsual got in touch with me at a time when a tribunal was coming up against my business. A meeting was arranged & all the nice things I wanted to hear were said. I was sold a 5 year contract with Peninsula @ £140.00 per month, I asked for a shorter term but was told 5 years was the only period they did. Do not Use Peninsula Business Services. I followed their advice to the letter. Their advice was wrong. My case went to tribunal. Peninsula messed up the case and we had 3 hour notice to settle or risk going to court. we settled and had to pay £3k. Peninsula would not pay!! that was that they said. This company are dispicable. Watch out for upcoming long running case of gabriel v peninsula at the manchester employment tribunal in July this year . An employee taking them for discrimination and sex discrimination . Won recent appeal in eat as well said she wasnt transferredto another employer by peninsula. Peninsula didnt seem to understand how tupe worked

Company took monthly subs, never complied with contract from the get go. Issues outstanding (like staff contracts) never resolved. Pleaded with them to deliver services, never did. Finally we asked for exit, no more payments and they then treatened us with breach and full costs for remaining 3.5 years. I have received today a court claim that Peninsula submitted.

Last year they gave me a wrong advise (they said that my employee is not entitle to maternity leave but she was), they send the letters after with apologies but I told them that I don’t want to continue the membership because they gave a wrong advice and they are in breach of contract . then they offer three months free but I still said that I do not want to deal with them because I don’t trust them any more. Unfortunately they didn’t feel the same way and they claim 6107.42 from me now. Do you think I have any chances? Any advice would be highly appreciated.

Do NOT use this company - they ignore any communications that you put to them and simply quote "you are tied in to a five year contract". I asked them to put together contracts for my staff. I spent 20 minutes on the phone with them and they simply copied my existing contracts and staff handbook, then e-mailed them back to me. If you try to end the agreement or refuse to pay (based on the fact that they just don't provide any service), they will take you to court. Yes I had same issues with them but have now left them, found a great company called Wirehouse employer service. Great advice and you get your own consultant no hidden indemnity clauses. Absolutely brilliant wish I had used them in the first place

The fact that you can only take out a 5 year contract should alarm you. Most companies provide a good service and expect their customers to return. This is clearly not the case with peninsula. Most advisors I have spoke to could care less about the issues in our organisation. We've had a nightmare time with them. We owned a farm shop and our shop manager signed a contract with them for 5 years which we did not approve.

Well well, just had a reply from my letter, (3months prior to contract end) stating peninsula require min of 6 months and my contract will be renewed for a further 12 months, much against my needs or wishes.
As all of the reviews on this link I have to agree with them all, I have only once asked for there help, of which they e-mailed me a pre filled form, with NO follow up from peninsula. (i could have googled it & got it for free)

Poor service. Standard forms that you can get any where . Hidden terms and conditions this company is after one thing and it is your money. Do you think a 6 month notice period on 1year contact is ethical? When considering after 9 months you haven't had a completion of serviceS promised on which to make a decision on whether or not to continue that contract.
