This is the letter i have sent to Everest and I received a letter saying it had been passed to their Customer Service Manager Oh good I thought progress but today I have received a letter from the original Branch Manager stating that if i don't pay in 7 days he will hand the claim to the Legal Team and that he doesn't think we deserve any compensation
I am discussed by their service
Dear Sir/Madam,
I am writing with regard to the invoice sent to us on 13/07/09 with regard to the outstanding amount of £2105.00. We were told that compensation for the problems and inconvieniance we had during the installation would be calculated at the end however the branch manager does not agree that we need any compensation.
Listed below are the problems we encountered during the period of installation with yourselves.
1. a company representative phone and booked for the scaffolders to come and erect the scaffolding on Tuesday 9th June 2009, during the morning my partner took half a day off and when no one had arrived he phoned to check that they were actually coming, he was told that they would be there that morning. He later spoke to the branch manager and said that he did have work to go to and that he was not happy with the loosing a whole days holiday. I received a phone call to say that the scaffolders had been held up at their previous job and that they would not now be arriving till the following week and the job was not going ahead as the weather was forecast to be wet. my partner lost a days holiday in all this. Your branch manager however said that he cancelled the scaffolders as my other half said he was going to work. This is blatantly not true.
2 The scaffolders arrived on the following Monday morning at the cost of another half day holiday for my partner on Monday 15th June 2009
3 When I returned home the scaffolding was in breach of health and safety and despite severely desperate phone calls to your offices to get it corrected it was not. The issues were:-
i the third storey bedroom is a fire escape with internal escape ladder and is used by my two children as their bedroom, both opening windows in the bedroom where blocked by scaffolding. due to this fact we had to make beds up in a small spare room for both boys to ensure their safety. This was at great inconvieniance to myself and the children.
ii scaffold pole left on the grass on the lawn (trip hazard)
iii No toe boards on the top platform
iv nail sticking out of the scaffold board
v bars at head height in front off a door way.with no hazard markings
4 When I called to complain about the scaffolding the lady that answered the phone asked me why I hadn't said something whilst they were erecting the scaffolding, which i find a madness do you rely on all your customers to supervise your sub contractors? And why was I expected to be the one to ensure you comply with regulations?
5 We had been assured that the scaffolding would be corrected the next day on my return from work the following evening it had not and my children endured another cramped night in the spare room.
6 After a phone call I was assured it would be rectified but this was Wednesday by now and it had cost us several more phone calls. We had enquired if the rooms would be habitable throughout the installation and we were told yes they were not.
7. On Thursday morning I came downstairs to find a large puddle of water in the utility room dripping from the ceiling. Your branch manager says the surveyor reported water damage on this carpet prior to your installation but he never mentioned this to myself or my partner. The only marks that were on the carpet are due to the fact it connects the garden to the front of the house and bikes are taken through there daily. Regardless of whether the carpoet was dirty or not I had the trouble of collecting water that was coming in through the ceiling before work. If we had been told that this would happen we could have made provisions to catch the water. It comes down to blatant disregard for us and our property. (photographs of the water are enclosed on the disc accompanying this letter.
All in all we have endured a lot of trauma and stress through no fault of our own during this installation and were happy that as a gesture of good will some compensation for our troubles would be forth coming. This has not been the case. The completion certificates have not yet arrived and now I am being threatened with late payment clauses. I hope that this matter can be resolved amicably as you came highly recommended by a Civils Engineer in the construction business that uses you frequently and I myself work in civil engineering and am disappointed in your level of service not in your product but your customer services.
