Just spoke to Tenon Recovery, they say to wait for the letters to come through and fill in forms that need to be sent back asap.
Also spoke to Consumer Helpline and they said as they have gone into liquidation, there is nothing that can be done except persuing the liquadator to get your money back. It seems I've lost my £7000 as I paid by banker's draft!

on 5th Jan 2009I too am claiming from Barclaycard through Section 75 for the full amount as I paid the deposit of £1000 with the card and the rest by my debit card.They are yet to reply.I know it is a legal entitlement but I am still anxious that they will come up with some excuse not to pay.Please comment on how you get on.

on 6th Jan 2009I called Barclaycard on 23rd Dec as I had paid my deposit by Visa and they said they will send me forms to fill in. Still waiting for the forms. Somehow I think they will not pay out. I also called Tenon Recovery and they said the forms I filled in before Christmas are being looked at but there doesn't look like any funds being available. I think D C Cook knew they were going down and still took our money with no intention of getting any cars. There must be some kind of law against this??

I put in a section 75 claim with Bank of Scotland end of December (Halifax One credit card), I had no forms to fill in. I just sent over details (credit card statement/bank statement) of what I had paid to Changing Gear Ltd, along with letters received from Tenon Recovery.
I have just signed declaration form today for full monies owed to me. Already received my £1k deposit back, will receive remaining £8k+ cheque early next week.mozzer2
on 30th Jan 2009Glad Halifax are paying out so quickly. Lloyds have already paid me my £7200 thru Visa Debit Chargeback. Yet my deposit paid on the Credit Card is the one dragging on.

As i mentioned previously, processed a claim against Barclaycard for full amount under Credit Act, but as nothing had happened and upon reading other reviews, have just received £18K back from debit card services, which i used to pay balance due when they said the car was ready. Pursuing the remaining £2K with Barclaycard, but thankful the bulk is back and promptly. Good luck to everyone else - take it you all had letter from gentleman whose wife is a solicitor and will be pursuing a case against DC cook?

on 5th Apr 2009Delsort - I wonder whether you had any joy with Barclaycard? We had a credit for the deposit put on the account but they are staying quiet with regard to the remainder which was paid by bank transfer.

on 6th Apr 2009I had the deposit refunded by Barclaycard but they are still looking into the remainder which I payed by Banker's Draft. I spoke to Talon Recovery and it doesn't look like there's going to be any money returned to anyone except the banks. They said they are still trying to sell whatever assets they had. They said it could take weeks, months and even a couple of years to finally close the books.

on 7th Apr 2009Thanks for the info - we are in the same position it seems. I have been advised to speed Barclaycard up by referring to the Financial Ombudsman.

on 2nd May 2009Just an update. Barclaycard were very slow to respond - they were much faster once the ombudsman's complaint was received. They want proof that my bank won't reimburse me which is fair enough, but also say that they are trying to contact dc cook's bank on my behalf. This is not what section 25 protects against - they should reimburse and then pursue their own refund. How are you getting on?

on 2nd May 2009My wife called Balrclaycard and they say they are still looking into it. We should get an answer soon. They say there are a few claims against DC Cook and they are going throught them. I called Tenon again and was told that they have sold everything they could of D C cook and are now investigating the directors. They don't think much will come out of it.

on 21st May 2009Chased Barclaycard last week and they said they are in the process of getting my money back.
On Monday this week, my money was credited to my account. I'm one of the lucky ones. I'm never going to give any money until I've seen the goods. A warning to everyone, if the vendor can show you the car, then don't buy it.wriggler1
on 21st May 2009That's great news. Our experience of Bcard customer services has been similar to that of DC Cook's so far - impossible to get hold of, unreturned calls, requests for information 4 months after first sending them it. Fingers crossed, and yes, same here, - a lesson learned!

Do not know if any of you paid any amount by credit card (ie deposit), but if so write to your credit card company and claim under section 75 of the consumer credit act 1974 for the FULL amount.
The credit card company are equally liable as long as over £100 and under £30000 paid.
I am into them for £21000, but hope to claim this way as paid £2000 on barclaycard. Consumer direct and google will help you with any further info if required - don't hold out much hope for any other payout.
