“METRO SAYS IT IS OKAY TO STEAL FROM A PERSON WITH A...”

We were told by their 'fraud department' that a vulnerable adult who flagged phantom cash withdrawals is never entitled to a refund because of his disability (requiring help with Banking). We were told that it is impossible for them to judge how much of the stolen money may have benefitted the account holder (100% I'd say...) and that in this case it is okay to steal from a vulnerable adult, as it's only their word. METRO forgot that they are liable unless they can prove the transactions flagged to be genuine. They went quiet for 9 Months before denying liability. The Bankers handbook says the Bank is liable and is to flag 'theft by misrepresentation' to the Police. They didn't do this and said 'sorry- we're not liable as you may have disclosed the PIN to your carer and you possibly did not take care of your card enough. They came to this conclusion as follows: The carer had a key to your home. You admitted that you left the card at home when you didn't need it. The carer had therefore access when you weren't at your flat. The keyholder could then enter the flat and retrieve the card from it's unsafe place (a drawer) and used it. Because a third party had a key and the card wasn't in a secure place within the home and the person is a vulnerable adult who is reliant on sharing banking information with a person of trust and the 'stolen' money may have benefitted the vulnerable adult in some way or another METRO does not need to prove that the transactions flagged were indeed unauthorised. Furthermore it didn't cross their mind that these phantom cash withdrawals could have been made by an unknown third party, nor did they provide any proof to show that at least 1 transaction had been made by the carer...
