“Cancelling contract ”

written by lvShaffer1981 on 19/03/2016

This is without prejudice..... Having signed up to Penninsula a year for
a 5 year contract( I couldn't afford a shorter term and was advised to
take it over 5 years ) , unfortunately my business had to close as it
wasn't viable and I no longer had any employees , it was a small
business and I only had limited usage of Penninsula , after contacting
them and informing them of my closure and could I cancel the contract as
there wasn't a get out clause and in my naivety I hadn't fully
understood that if the business closed I would be liable . It wasn't
something that was pointed out to me at the time of signing . I have had
a couple of telephone conversations and have been told that I can pay a
reduced fee , the will cancel the insurance which equates to 6% and
then a further 10% as a gesture of goodwill , this now reduces my
liability from just over £5000 to just over £4000 or take it as a
reduced monthly payment for the next 4 years ?!?! . I have also
requested this in writing but just got an email response saying they
would reduce the monthly repayment !! ( no committing to a figure) ..
After 6 months of trading I also made the company LTD and phoned
Penninsula to inform them , having contacted them last week to say the
business has closed conveniently they don't have a record of my
conversation and my contract is still as a sole trader .

I have asked if I can pay for the services already used as this
seemed fair considering that as I wouldn't be using their services any
more i would therefore not be costing the company any money !!..

I was again told no !! ... There was no getting out of it I will
have to pay for the next 4 years she said and as a single parent ( with a
child who is a chronic migraine sufferer and one with aspergers they
need me to be around) trying to get on in life and support my family and
not rely on benefit , there is no empathy for exceptional circumstances
and its a hard lesson learned in an already hard world ... I totally
understand if it's a car or coffee machine that I still possessed but I
have nothing !! ... Shame on Peninsula ...
