“dw fitness threatening court action”

Written on: 14/08/2012 by dstar123 (1 review written)

Dw fitness is a joke became a member but after 4 months had to cancel due to not only becoming pregnant but having a high risk pregnancy! Sent cancellation letter and thought that's it, now I'm being harassed by ARC who state the only way I can cancel is if I'm terminally ill and dying!!!! I am currently under a consultant as I have a bleed near my placenta and have been told to do basically nothing or I could loose my baby, I informed ARC this to there reply was SO, pregnancy is not a reason to cancel and then began asking very personal questions WTF How do these people get away with this and the stress they are putting me under immense ringing me continuously leaving voice mails sending letters surely this isn't allowed??

I'm sorry to hear that you are having problems that are putting you under stress. Sadly this is allowed....when you signed up with DW you will have signed a gym contract that will have had terms and conditions covering all aspects of the membership, including valid reasons for exiting your contract early. For most gym companies pregnancy isn't a valid reason for exiting your contract, as in theory you could freeze it and begin exercising again when you've had your baby. Some gym companies have a clause whereby if you can provide a doctors note to state you are unfit to exercise they will freeze for free, or even allow you to cancel early - but DW sadly are not one of these companies.

Sadly gym companies can't take any excuse for exiting a contract early at face value, as the majority of people will simply be spinning a yarn because they just don't want to go anymore!

The long and the short of it is that you told DW they could expect you to be a member for a certain time, and unfortunately they're going to try and recover that through debt collection. The plus side is that you may be able to come to arrangement with the debt collection company whereby you pay it by small installments each month.

Good luck, and I hope all goes well with your baby!
