Hi I got my car in October 2015, I have not paid since February as my car is constantly in the garage, fair play they have just paid £1300 to change turbo on my car but its still broke and I'm not happy to pay them, but don't want to give it back as I've nearly £1000 already and need a car, there's nothing on my credit file about them and I did a hpi check on my car and it has no outstanding finance, will I get in trouble if I sell it?

I don't want to alarm anyone but, I'm in negotiations with Shoosmiths at the moment regarding a car which was financed in 2014 by C4C. It was not purchased on HP but on finance which paid outright for the vehicle directly to the trade seller, I think this is called PCP? Anyhoo, when Avelo took over C4C they decided to call my finance HP (& there is and has never been a HPI marker on the vehicle). To cut a long story short, the vehicle was reported as STOLEN in 2013 & the insurers at the time paid their client on the claim so the car has always been the legal custody of the 2013 insurance firm. It seems the owner of the car in 2013 committed insurance fraud & got rid of the vehicle through the garage from which I brought it in 2014 - since then, the car has had a STOLEN tag attached to it (added by the claimants insurers in case it ever turned up). All this only came to light when I went to trade in the car for a new one & the tag was flagged up by the new dealership. I'm now stuck with a car that legally has never belonged to me but Avelo are demanding payments for. I've been in contact with the insurers who paid out their claimant & at present they are negotiating ownership of the vehicle with Shoosmiths. Obviously the outcome will be that the insurers are the legal owners as they paid out on the fraudulent claim which leaves me wondering if.........My initial finance agreement should be cancelled as the car should never have been sold through C4C in the first place (I believe they knowingly sold me finance on a car that did not legally belong to the garage because they had a DEAL going with them to shift as many cars as they could & both C4C & the garage have since ceased trading), furthermore, I am fully entitled to a full refund on the 2 years finance payments I've already paid to C4C
as I've never owned the vehicle (according to the insurers) even though my finance agreement states I do. I should also be compensated for what I've paid out on the car regarding maintenance, Insurance & tax etc. I can't sell or trade in the car now as I DON'T legally own it. I'm literally just waiting for the original insurers to come & pick it up should they decide it's their property & want to sell it to get back some of the money they paid out on the claim in 2013? It's all very confusing but what I am anticipating is a long drawn out argument with Avelo, losing my car & having no money to buy another one - in essence - STRANDED!
